The New Procurement Act: 3 Ways it’s Now Easier to Find Tenders.

The UK’s departure from EU-derived regulations has led to the Procurement Act 2023, a landmark piece of legislation designed to make public spending more transparent and accessible. For the first time in 30 years, the barriers that once made it difficult for smaller firms to find tenders are being dismantled. Here is what you need to know about the new landscape.
 
1. The Central Digital Platform: A Single Source of Truth
In the past, you might have spent hours scouring different portals for different regions. Under the new Act, the Find a Tender service has been enhanced to act as a Central Digital Platform (CDP).
  • Register Once, Bid Often: You can now store your core business credentials—such as accounts, insurance, and company details—on the platform once.
  • Tell Us Once: When you find tenders you want to bid for, you simply share your unique supplier identifier or a digital “share code,” drastically reducing the time spent on repetitive paperwork for every new application.
 
2. Improved Visibility with Mandatory Pipeline Notices
One of the best ways to find tenders is to know they are coming before they are even live.
  • 18-Month Forecasts: Large public bodies (spending over £100m annually) are now legally required to publish Pipeline Notices for any upcoming projects valued over £2 million.
  • Strategic Planning: These notices provide an 18-month forward-looking view, giving you ample time to build the right partnerships or upskill your team before the official “Tender Notice” is even released.
 
3. Simpler Procedures: From 7 to 3
The Act has slashed red tape by condensing seven confusing procurement routes into just three:
  • Open Procedure: A single-stage process where any supplier can submit a bid.
  • Competitive Flexible Procedure: Allows buyers to design a bespoke process, which is often used for innovative or complex projects.
  • Direct Award: Reserved for urgent needs or specific protections, but now requires a Transparency Notice so the public can see exactly why the contract was awarded without a competition.

The Procurement Act 2023 isn’t just about new rules; it’s about a culture shift toward “Most Advantageous Tender” (MAT), where quality and local impact are weighed as heavily as price.
